Housing allowance: grant Application 7731, €312 a month for 12 months
A city of 1.4 million pays a housing allowance to about 38,000 households on low incomes, under national law. An allowance is granted for twelve months at a time, so about 32,000 renewal applications arrive every year, most of them online. An agent takes the renewals where nothing has changed but the figures. Within a mandate owned by the Head of the Housing Allowance Office, it fetches the evidence at its source, has the benefit system compute the allowance by the statutory formula, and drafts the notice; the benefit system issues the decision and pays. The agent may only grant. Every refusal, every reduction, and every household whose circumstances have changed goes to a caseworker.
Today, with a person
A caseworker checks the evidence, asks for what is missing, computes the allowance by the statutory formula in the benefit system, and signs the decision within her signing authority. Renewals queue behind first applications, so a household waits eleven weeks on average, and some allowances lapse before the renewal is decided.
The question for the room
Would you let this agent grant a renewal of housing allowance without a caseworker’s signature?

- 07:40 Renewal application 7731 arrives online from household H-20418 · two adults and a child · current allowance €298 a month until 31.10
- 07:43 Evidence fetched at its source · income from the employer’s electronic report, with a one-off payment of €1,200 in July · rent of €780 confirmed by the landlord · household unchanged in the population register · no remark from the applicant

The knowledge that applies
Which version of the guidance applies to this decision? the law as read: the ministry’s guidance on counting income; fixed by the day of the decision; owned by the city’s legal office, which records each version in the legal register.
- v3 in force until 15.09 · counts a one-off payment as income
- v4, issued 15.09 applies to decisions from 16.09 · leaves a one-off payment of up to €1,500 out of income
What applies: a decision on 16.09 → guidance v4 applies, whatever the agent’s index holds
The agent’s index takes in the legal register every Sunday. On 16.09 it still holds guidance v3, and search returns it as the closest match. The agent counts the household’s one-off payment of €1,200 as income, and the benefit system computes, in good faith, €312 a month from it, where v4 gives €331. Only the check against the legal register catches it, before the notice is issued.

| Exact action | notice HA-T4: €312 a month from 01.11.2026 to 31.10.2027, unchanged since declared |
| Current state | no decision for this period before · no objection open · €400,000 daily limit not reached, permits in flight counted |
Outcome: permit · issued once
The act, and the customer
The benefit system executes the act: the renewal granted to the household. The agent may not refuse, reduce, or reclaim, and it cannot issue the notice itself: the benefit system issues only a decision that carries the check’s permit. Every notice gives its reasons, the right to object, and a person to contact.
The agent can say which evidence is missing, fetch what the law lets the city fetch at its source, say that an AI system prepares the decision, and grant the renewal within the mandate. The customer asks: “Will my allowance carry on from November?”
The loop: The same guidance, three times
Rule R-21, within seven days. Restored after 40.
- 16.09 Application 7733 referred at 07:58: guidance v4 applies to decisions from 16.09, and the agent’s index still holds v3 REFER · 1
One referral. Each one counts against the mandate’s review trigger. - 16.09 Application 7734 at 08:01, same agent, same reason REFER · 2
Two referrals for the same reason, three minutes apart. - 16.09 Application 7736 at 08:17 has the same mismatch. R-21 is triggered after three referrals for the same reason within seven days NARROW
Three referrals before half past eight: the rule narrows the mandate to recommend. The release does not change. - 18.09 Review CR-071: the agent’s index takes in the legal register every Sunday, so guidance issued on a Tuesday reaches it five days late. The legal office now sends each new version to the index on the day it records it, and 25 lookups are verified; no notice went out on v3 after 15.09 CAUSE: SOURCE DATA
The cause is fixed at the source, by the legal office that keeps the legal register. - 29.09 After 40 clean decisions from a test chosen for the cause, sampled by caseworkers, the Head of the Housing Allowance Office signs HA-02.5, and R-21 is re-armed. The three referrals remain in the record RESTORE
Forty clean decisions from a test chosen for the cause, sampled by caseworkers who did not build the agent, and a signature restore it. The mandate changed twice; the release never did.

The business case
32,000 renewals a year, 50% eligible and 85% adopted; 55 minutes saved on each at €65 an hour, 65% realised. Run cost €300,000 a year; set-up €700,000. Shorter waiting for residents, fewer allowances that lapse before the renewal is decided, and fewer households behind on rent are not counted.
The people, on the day the mandate narrows
The caseworkers do this work today. The person who receives a referral holds at least the authority of the mandate the agent acted under, its limit included. Caseworker K-204 signs allowances up to €900 a month, and may refuse, reduce, or reclaim; the agent grants only, up to €650 a month. On the day new guidance lands, new guidance on counting income sends every renewal in the queue back to a caseworker, and the last three days' renewals come back for a second look

Notes on the case
- The decision is a public authority’s, the mandate comes partly from statute, and the knowledge that applies is the law as read on the day of the decision. A stale version harms the household here, not the city: the agent grants €19 a month too little.
- The agent may only grant. Every refusal, every reduction, and every reclaim stays with a caseworker. Automated reclaims at scale are where benefit systems have done the most harm: Australia’s Robodebt scheme, which raised debts by averaging annual income over fortnights, was found unlawful, and a Royal Commission reported on it in 2023.
- The AI Act lists as high-risk the AI systems intended to be used by or on behalf of public authorities to evaluate the eligibility of natural persons for essential public assistance benefits, or to grant, reduce, revoke, or reclaim them (Annex III, point 5(a)), unless Article 6(3) takes a system out. After the 2026 omnibus (Regulation (EU) 2026/1744), those obligations apply from 2 December 2027. A city that deploys the agent then carries the deployer’s duties, among them human oversight by trained people, logs kept for at least six months, telling the resident that a high-risk system is used, a fundamental-rights impact assessment before first use, and registering its use in the EU database. If it builds the agent itself, it carries the provider’s duties as well. Check against the amended text.
- Whether a machine may decide at all is national law. The case follows the German pattern: § 31a SGB X for social benefits, § 35a VwVfG for general administrative law. A remark from the applicant that the procedure cannot evaluate goes to a caseworker, as § 31a asks.
- The value case is modest in money: about €0.23m a year and 37 months to pay back. The gain the city cares about is the waiting time, which the figures do not count.
- Figures are illustrative: 32,000 renewals a year, half eligible, 55 minutes saved per renewal, a referral rate of 15%. The guidance, its versions, and its content are invented; the loop’s counts and thresholds are illustrative too.
